For attorneys who are unfamiliar with appellate practice in New Jersey, navigating the Court Rules can be arduous and slightly overwhelming. This article provides an overview of basic procedural and temporal requirements when filing an appeal in the New Jersey Appellate Division.
An appeal to the Appellate Division may be taken as of right from a final judgment of a trial division of the Superior Court. R. 2:2-3(a)(1). For purposes of an appeal as of right, a final judgment is one that resolves all issues as to all parties. If there are any issues that remain outstanding, the judgment is not final and may not be appealed as of right.
